Accommodation Terms and Conditions

  • Article 1 (Scope of Application)

    1. Contracts for accommodation and related agreements to be entered into between this Hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided herein shall be governed by laws and regulations and/or generally accepted practices.
    2. In the case when the Hotel has entered into a special contract with the Guest, insofar as such special contract does not violate laws and regulations and generally accepted practices, the special contract shall take precedence over the provisions of these Terms and Conditions, notwithstanding the preceding Paragraph.
  • Article 2 (Application for Accommodation Contract)

    1. A Guest who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:
      1. Name of the Guest(s);
      2. Date of accommodation and estimated time of arrival;
      3. Accommodation charges (based in principle on the Basic Accommodation Charges listed in the Attached Table No.1); and
      4. Other particulars deemed necessary by the Hotel.
    2. If Guests request to extend their stay, during their stay, beyond the date in item (2) of the preceding Paragraph, the Hotel shall regard it as an application for a new Accommodation Contract at the time such request is made.
  • Article 3 (Conclusion of Accommodation Contracts, etc.)

    1. Accommodation Contracts shall be deemed to have been concluded when the Hotel has accepted the application as stipulated in the preceding Article. However, the same shall not apply where it has been proved that the Hotel has not accepted the application.
    2. When an Accommodation Contract has been concluded in accordance with the provisions of the preceding Paragraph, the Guest is requested to pay an application deposit set by the Hotel within the limits of Basic Accommodation Charges covering the Guest’s entire period of stay (up to a maximum of three days in the case of stays longer than three days) by the date specified by the Hotel.
    3. The deposit shall be first used to cover the Accommodation Charge to be paid by the Guest, and secondly to cover the cancellation charges and any compensation for damages in that order if applicable under the provisions of Article 6 and Article 18. The remainder, if any, shall be refunded at the time of payment for accommodation as stated in Article 12.
    4. If the Guest fails to pay the application deposit by the date set by the Hotel as stipulated in Paragraph 2, the Hotel shall treat the Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel when the period of payment of the deposit is specified.
  • Article 4 (Special Contracts Requiring No Application Deposit)

    1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no application deposit after the Contract has been concluded as stipulated in the same Paragraph.
    2. In the case when the Hotel has not requested payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or did not specify the date of payment of the deposit at the time that application for the Accommodation Contract was accepted, it shall be treated as though the Hotel has accepted a special contract as prescribed in the preceding Paragraph.
  • Article 5 (Refusal of Accommodation Contracts)

    1. The Hotel may not accept the conclusion of an Accommodation Contract under any of the following circumstances:
      1. When the application for accommodation does not conform with the provisions of these Terms and Conditions;
      2. When the Hotel is fully booked and there is no vacancy;
      3. When the Guest seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate laws or act against the public order or good morals in regard to his/her accommodation;
      4. When the Guest seeking accommodation is deemed to clearly have an infectious disease;
      5. When the Guest requests the Hotel to bear an unreasonable burden with regard to accommodation;
      6. When a natural disaster, trouble with facilities, or other unavoidable causes prevent the Guest from staying at the Hotel; and
      7. When accommodation falls under the provisions of Article 16 of the Enforcement Regulations of the Nagano Prefecture Hotel Business Act.
  • Article 6 (Right to Cancel Accommodation Contracts by the Guest)

    1. The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.
      1. If the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case when the Hotel has requested payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest has cancelled before payment), the Guest shall pay cancellation charges as listed in the Attached Table No. 2. However, in the case when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the Guest is informed of the obligation of payment of cancellation charges in case of cancellation by the Guest.
      2. If the Guest does not appear by 7:00 p.m. of the accommodation date without advance notice (or 2 hours after the expected time of arrival if the Hotel is notified), the Hotel may regard the Accommodation Contract as being cancelled by the Guest.
    2. In the case when the Hotel has not requested payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or did not specify the date of payment of the deposit at the time that application for the Accommodation Contract was accepted, it shall be treated as though the Hotel has accepted a special contract as prescribed in the preceding Paragraph.
  • Article 7 (Right to Cancel Accommodation Contract by the Hotel)

    1. The Hotel may cancel the Accommodation Contract under any of the following circumstances:
      1. When the Guest is deemed liable to conduct himself/herself in a manner that will violate laws or act against the public order or good morals in regard to his/her accommodation, or has conducted himself/herself in such a manner;
      2. When the Guest is deemed to clearly have an infectious disease;
      3. When the Guest requests the Hotel to bear an unreasonable burden with regard to accommodation;
      4. When a natural disaster or other force majeure prevent the Guest from staying at the Hotel; and
      5. When accommodation falls under the provisions of Article 16 of the Enforcement Regulations of the Nagano Prefecture Hotel Business Act.
      6. When the Guest smokes in an area other than the designated smoking area, tampers with firefighting equipment, etc., or otherwise fails to comply with the prohibitions set forth by the Hotel in the Rules of Use (limited to those necessary for fire prevention); and
      7. When the Guest seeking accommodation is a gang, gang member, gang-related organization, gang-related person, or other anti-social force.
    2. In the event that the Hotel cancels the Accommodation Contract based on the provisions of the preceding paragraph, the Guest will not be charged for services, etc. that the Guest had not received.
  • Article 8 (Registration)

    1. The Guest shall register the following particulars at the Front Desk of the Hotel on the day of accommodation:
      1. Name, age, sex, address, and occupation of the Guest(s);
      2. Nationality, passport number, port and date of entry in Japan if a foreign national;
      3. Date and estimated time of departure; and
      4. Other particulars deemed necessary by the Hotel
    2. In the case where the Guest intends to pay his/her accommodation charges prescribed in Article 12 by any means other than Japanese currency, such as traveler’s cheque, accomodation vouchers or credit cards, these shall be presented in advance at the time of the registration prescribed in the preceding Paragraph.
  • Article 9 (Occupancy Hours of Guest Rooms)

    1. The Guest is entitled to occupy the contracted guestroom of the Hotel from 3:00 p.m. on the day of arrival to 10:00 a.m. on the following day. However, in the case when the Guest is accommodated continuously, the Guest may occupy the guestroom all day, except for the days of arrival and departure.
    2. The Hotel may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the guestroom beyond the time prescribed in the same Paragraph. In this case, extra charges shall apply as follows (rates vary depending on room type):
      1. Up to 1 hour over: 3,300 yen or more, equivalent to the room charge
      2. Up to 2 hours over: 5,500 yen or more, equivalent to the room charge
  • Article 10 (Observance of Hotel Regulations)

    1. When within the premises of the Hotel, the Guest shall observe the Rules of Use established by the Hotel and posted within.
  • Article 11 (Business Hours)

    1. The business hours of the main facilities of the Hotel are as follows. Detailed information on the business hours of other facilities can be found in the pamphlets provided, on notices posted in various locations, and in the service directory in guestrooms.
      1. Front Desk, Cashier, etc. Service Hours:
        1. Curfew: 00:00 am
        2. Front Desk Service: 7:00 a.m. to 11:00 p.m.
      2. Food, Beverage, etc. (Facility) Service Hours:
        1. Breakfast: 7:30 a.m. to 9:00 a.m. (banquet halls and dining rooms)
        2. Dinner: 6:00 p.m. to 9:00 p.m. (banquet halls and dining rooms)
        3. Other food and beverages
          Lounge: 7:30 a.m. to 2:00 p.m.
          Bar: 5:00 a.m. to 9:00 p.m.
      3. Ancillary Service Facility Hours:
        1. Kiosk: 8:00 a.m. to 9:00 p.m.
    2. The hours set forth in the preceding Paragraph are subject to temporary change if necessary or unavoidable. In such cases, notification will be given by appropriate means.
  • Article 12 (Payment of Accommodation Charges)

    1. The breakdown of accommodation charges, etc. that the Guest shall pay is as listed in the attached Table No.1.
    2. Accommodation charges, etc. as stated in the preceding Paragraph shall be paid at Front Desk at the time of the Guest’s departure or upon request by the Hotel in currency or other means acceptable to the Hotel such as traveler’s cheques, accommodation vouchers, and credit cards.
    3. After the Hotel provides the room for the Guest and the room has become available, accommodation charges shall be paid even if the Guest voluntarily does not utilize the room.
  • Article 13 (Liabilities of the Hotel)

    1. The Hotel shall compensate the Guest for damage if the Hotel has caused such damage to the Guest in the fulfillment or the nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in cases where such damage has been caused due to reasons for which the Hotel is not liable.
    2. Although the Hotel has been certified by the fire department, the Hotel is also covered by Hotel Liability Insurance to deal with unexpected fire and/or other disasters.
  • Article 14 (Handling when Unable to Provide Contracted Rooms)

    1. The Hotel shall, when unable to provide contracted rooms, arrange accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest.
    2. When arrangement of other accommodation cannot be made, notwithstanding the provisions of the preceding Paragraph, the Hotel shall pay the Guest a compensation fee equivalent to the cancellation charges and the compensation fee shall be applied to reparations. However, when the Hotel cannot provide accommodation due to causes for which the Hotel is not liable, the Hotel will not compensate the Guest.
  • Article 15 (Handling of Deposited Articles)

    1. The Hotel shall compensate the Guest for damages when loss, breakage or other damage is caused to goods, cash or valuables deposited at the Front Desk by the Guest, except in the case when this has occurred due to causes of force majeure. However, for cash and valuables, when the Hotel has requested the Guest for the report of the nature and value thereof and the Guest has failed to do so, the Hotel shall compensate the Guest up to a maximum of 150,000 yen.
    2. The Hotel shall compensate the Guest for damages when loss, breakage or other damage is caused, through intent or negligence on the part of the Hotel, to the goods, cash or valuables brought onto the premises of the Hotel by the Guest but are not deposited at the Front Desk. However, for articles of which the nature and value has not been reported in advance by the Guest, the Hotel shall compensate the Guest up to a maximum of 150,000 yen, except when due to intent or negligence on the part of the Hotel.
  • Article 16 (Custody of Baggage and/or Belongings of Guests)

    1. When the baggage of the Guest is brought into the Hotel before his/her arrival, the Hotel shall be liable to store it only in the case when such a request has been accepted from the Hotel. The baggage shall be handed over to the Guest at the Front Desk at the time of his/her check-in.
    2. When the baggage or belongings of a Guest are found in the Hotel after check-out and ownership of the article is confirmed, the Hotel shall contact the owner and seek instructions. However, when no such instructions are given to the Hotel by the owner or when ownership is not confirmed, the Hotel shall retain the items for a period of seven days, including the day of discovery, after which they will be disposed of or delivered to the appropriate authorities. However, food and beverages will be disposed of immediately.
    3. The Hotel’s liability in regard to the custody of the Guest’s baggage and/or belongings in the case of the preceding two Paragraphs shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article in the case of Paragraph 2.
  • Article 17 (Liabilities regarding Parking)

    1. When the Guest uses the Hotel’s parking lot, the Hotel shall be considered only to be lending the parking space and shall not be liable for the management of the vehicle, regardless of whether or not the Guest has deposited the key to the vehicle. However, the Hotel shall be liable to compensate the Guest in the event of damages caused in the course of managing the parking lot through either intention or neglect on the part of the Hotel.
  • Article 18 (Liabilities of the Guest)

    1. The Guest shall compensate the Hotel for any damages incurred by the Hotel through intention or neglect on the part of the Guest.

  • Notes

    1. The basic accommodation charge is based on the rate table posted at the Front Desk.
    2. The child rate applies to elementary school students and younger. 80% of the adult rate is charged when meals and bedding equivalent to those for adults are provided, 60% when meals and bedding for children are provided, 50% when meals and bedding for toddlers are provided, and a facility usage fee of 3,300 yen is charged when no meals or bedding are provided.
    3. If the number of contracted days is reduced, the penalty incurred shall be for one day (the first day) regardless of the number of days reduced.
    4. In the event of partial cancellation of a contract by a group of guests (15 or more), no penalty will be charged for 10% (fractions rounded up) of the number of guests as of 10 days prior to the date of stay (or the date of acceptance if the application was accepted on a later date).

Handling of Personal Information

Kamisuwa Onsen Shinyu adheres to the following regarding the protection of Guests’ personal information.

  • *SSL encryption technology is used for reservations on the website.
  • *Cookies are used to make the website easier to use.
  • *The Hotel is covered by AIG’s personal information leakage insurance.
  1. Yukiteru Yanagisawa, the Company’s president and CEO, is responsible for the management of information pertaining to Guests (hereinafter “personal information”).
  2. The Company shall take safety measures for both hardware and software against personal information-related risks, such as unauthorized access to personal information and leakage of personal information.
  3. The Company shall properly manage personal information collected from Guests, and shall not provide or disclose personal information to any third party, except when required by law or when necessary to protect the rights or property of the Company.
  4. The Company may email Guests information on services likely to be beneficial to them. Guests may opt out of receiving such emails by contacting the Company.
  5. Guests may make inquires regarding their personal information as well as requests for correction, etc. by contacting the Company, and the Company shall respond as quickly as reasonably possible.
  6. The Company shall comply with all applicable laws, regulations, and norms pertaining to the personal information retained by the Company, and shall review and improve the efforts set forth above as appropriate.
